Welcome to Therapify, a revolutionary application designed to provide psychological support through an interactive chatbot experience powered by OpenAI technology. This application enables users to discuss their personal issues in a chat-based format, offering a unique approach to self-help and mental well-being.
Description of the Service: Therapify allows users to register using Apple Sign-In and engage in therapeutic sessions with a chatbot. Users are required to provide personal information such as age, gender, marital status, and name, which is utilized to tailor the therapy sessions. This application is intended for adult users fluent in English across various regions.
By using Therapify, you agree to these terms and conditions. These terms govern your use of the app and provide important information about your legal rights. It is important that you read and understand them.
PLEASE NOTE THAT THESE TERMS CONTAIN AN ARBITRATION CLAUSE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND Therapify AGREE THAT DISPUTES RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND Therapify WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
User Registration: To access Therapify's features, users must register and create an account using Apple Sign-In. This process is designed to streamline user experience and enhance security. During registration, users are required to provide accurate and current personal information including age, gender, marital status, and name.
Account Integrity: Users are responsible for maintaining the confidentiality of their account and password. They should take all necessary steps to ensure that their account password remains confidential and secure. Users agree to accept responsibility for all activities that occur under their account or password.
Data Accuracy: Users must provide accurate and truthful information during the registration process and are expected to update this information if it changes. Therapify reserves the right to suspend or terminate accounts with incomplete or inaccurate information.
By creating an account, users agree to these terms regarding their account's integrity and the accuracy of their personal information.
Service Functionality: Therapify is designed to provide users with psychological support through a chat interface. Users interact with an AI-powered chatbot to discuss personal issues, seek advice, and receive support.
Session Payments: To access a therapy session, users must select a psychologist profile and make a payment for each session. Payments are processed securely through Apple Pay, and no personal payment information (such as credit card numbers or billing addresses) is stored in the app.
User Conduct: Users must engage with the AI chatbot in a respectful and appropriate manner. The chatbot is intended solely for personal therapeutic conversations. Users are prohibited from using the chatbot for other purposes, such as requesting code writing or engaging in non-therapeutic discussions. Each session should focus on a single individual's issues; discussing multiple individuals in one session is not permitted.
Limitations of AI Therapy: The AI chatbot is a tool for support and not a substitute for professional psychological advice, diagnosis, or treatment. Users with serious mental health issues are encouraged to seek professional help.
Medical disclaimer Therapify is a provider of software and content designed to improve your mood and emotional wellbeing. However we are not a healthcare or medical device provider, nor should our Services be considered medical care, mental health services or other professional services. Only your physician or other healthcare providers can do that. While there is third party evidence from research that certain conversation techniques implemented in Therapify can assist in the recovery process for a wide array of conditions, Therapify makes no claims, representations or guarantees that the Services provide a therapeutic benefit.
Emergencies Use of the Services is not for emergencies. If you think you have a medical or mental health emergency, call 911 or go to the nearest open clinic or emergency room.
If you are considering or committing suicide or feel that you are a danger to yourself or others, you must discontinue use of the Services immediately, call 911 or notify appropriate police or emergency medical personnel.
By using Therapify, users agree to these usage terms and acknowledge the limitations of AI-based therapy.
Collection of Personal Information: Therapify collects personal information such as age, gender, marital status, and name during the registration process. This information is used to personalize the therapy sessions and improve the user experience.
Sharing of Information with OpenAI: User messages and interactions with the AI chatbot are processed using OpenAI's technology. This involves transmitting user messages to OpenAI for analysis and response generation. Therapify ensures that data shared with OpenAI is done so in a manner that respects user privacy and confidentiality.
Third-Party Tools for Performance Monitoring: The app utilizes third-party tools like Sentry for monitoring application performance and diagnosing issues. Data collected for these purposes may include app usage statistics and error reports but does not include personal therapy session content.
Data Security: Therapify employs various security measures to protect user information and prevent unauthorized access, use, or disclosure. However, no method of transmission over the internet or method of electronic storage is 100% secure.
User Consent: By using Therapify, users consent to the collection, use, and sharing of their personal information as described in these terms.
Use of OpenAI: Therapify integrates OpenAI technology to power the AI chatbot. This integration is crucial for the functionality of the app, enabling it to process and respond to user queries effectively.
Apple Services: The app utilizes Apple Sign-In for user registration and Apple Pay for processing payments. These integrations offer users a seamless and secure experience while ensuring that sensitive payment information is handled by Apple's trusted systems.
Performance Monitoring Tools: Therapify employs Sentry for real-time error tracking and performance monitoring. This helps in maintaining app stability and improving user experience. Data collected through Sentry is used solely for these purposes and is handled in accordance with our privacy policy.
Integration with Third-Party Services: Users acknowledge that Therapify integrates with these third-party services and that their use of Therapify is subject to the terms and conditions and privacy policies of these third parties.
By using Therapify, users agree to the use of these third-party services as essential components of the app's functionality.
Appropriate Use of the Service: Users must use Therapify solely for personal therapeutic purposes. It is prohibited to use the chatbot for any non-therapeutic purposes, such as asking non-related questions, requesting technical support unrelated to the therapy sessions, or using the chatbot for entertainment.
Session Limitations: During a therapy session, users should discuss issues pertaining to only one individual. Discussing multiple individuals or sharing information about others without their consent is not allowed.
Compliance with Terms: Users must comply with all the terms and conditions outlined in this agreement. Failure to comply with these terms may result in the suspension or termination of the user's account and access to the service.
Reporting Issues: Users are encouraged to report any issues or concerns with the AI chatbot or the service to Therapify’s support team for prompt resolution.
By using Therapify, users agree to adhere to these responsibilities and use the service in a manner that is respectful and compliant with these terms.
Ownership: All rights, titles, and interests in and to the Therapify app, including but not limited to its design, interface, source code, images, text, and all other intellectual property, are the exclusive property of the app developer. This includes any modifications, updates, or enhancements to the app.
Restrictions: Users are not permitted to copy, modify, distribute, sell, or lease any part of the app, nor may they reverse engineer or attempt to extract the source code, except as laws prohibit these restrictions or as permitted by the app developer.
User Content: Users may provide feedback, suggestions, or other information about the app’s usability, functionality, or issues. By providing such information, users grant the app developer a perpetual, irrevocable, non-exclusive, royalty-free license to use and incorporate this information into the app.
Trademark: The name "Therapify," its logo, and other related graphics, logos, and service names used in connection with the app are trademarks of the app developer. Users are not granted a right or license to use these trademarks.
Becoming a member: You will be required to register ("create an account") with Therapify and become a Therapify Member in order to access and use the Services. If you choose to register for the Services, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the registration forms. Registration data and certain other information about you are governed by our Privacy Policy.
Once a member: You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify Therapify of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Services. Therapify will not be liable for any loss or damage arising from your failure to comply with this Section.
Your membership: As an Therapify Member, you will receive access to content, features, and functions of the Services that are not available to non-members.
By agreeing to become a Member you opt-in to receive occasional special offers, marketing, survey, and Services-based communication emails. You can easily unsubscribe from Therapify commercial emails by following the opt-out instruction in these emails. Therapify memberships and subscriptions are not transferable and therefore cannot be sold or exchanged or transferred in any way whatsoever.
Subscriptions: Once you become a Therapify Member, you can choose one of the subscription programs offered in Therapify:
You can become a subscriber to a paid subscription program (b) or (the "Paid Subscriptions") by purchasing a subscription to the Services within the Apps, where allowed by the App marketplace partners (Apple iTunes Store and Google Play store).
Maintaining a Paid Subscription: Any of our paid subscriptions shall be paid in monthly, semi-annual or annual installments and processed by the App marketplace partner through which you originally acquired the subscription.
You will only have access to a paid subscription while it is active and subsisting. Should you fail to pay your subscription within 7 days after a due date, you will automatically downgrade to "Free Use".
The renewal subscription fees will continue to be billed to the Payment Method you provided through the marketplace, automatically until canceled. You must cancel your subscription before it renews each billing period in order to avoid billing of the next subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-month subscription period. You can modify or cancel your paid subscription only through the App marketplace where you originally acquired the subscription. To view, modify or cancel your subscription, you may be required to be authenticated under the same user ID by the marketplace partner.
Refunds Please note that if you purchase a subscription through the Apple iTunes Store or our iPhone application, the sale is final, and we will not provide a refund. Your purchase will be subject to Apple’s applicable payment policy, which also may not provide for refunds.
Acknowledgment of AI Limitations: Users acknowledge that Therapify is a support tool and not a replacement for professional psychological advice, diagnosis, or treatment. Users are advised to seek professional help for serious mental health issues.
Liability Waiver: The app developer is not liable for any decisions, actions or outcomes resulting from the use of Therapify. Users assume full responsibility for their use of the app and any consequences that arise from that use.
No Guarantee of Accuracy: While efforts are made to ensure the accuracy and effectiveness of the responses provided by the AI chatbot, the app developer does not guarantee that the information provided will always be accurate, complete, or applicable to the user’s individual circumstances.
Indemnification: Users agree to indemnify and hold harmless the app developer, its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of their use of Therapify, their violation of these terms, or their violation of any rights of another.
